1. Agreement
These Terms of Service (“Terms”) govern your use of the ScanBite mobile application and related services (“Service”) operated by Alright Tech. By downloading or using the App, you agree to these Terms and our Privacy Policy.
2. Eligibility
You must be at least 13 years old (or the age of digital consent in your jurisdiction) and able to form a binding contract. If you use the App on behalf of an organization, you represent that you have authority to bind that organization.
3. The Service
ScanBite uses AI to estimate nutrition from food photos. Features may include meal logging, history, analytics, optional wellness tools, Health Coach chat, meal plans (availability may vary by subscription tier), cloud backup, and freemium scan limits with optional rewarded advertisements.
We may modify, suspend, or discontinue features at any time. Beta or experimental features are provided “as is”.
4. Subscriptions & payments
- Premium features may require a paid subscription processed through Stripe (or future in-app purchase providers).
- A free trial may be offered once per user/device where applicable. After the trial, your subscription renews automatically unless cancelled before the renewal date.
- Prices, billing cycles, and taxes are shown at checkout. You are responsible for applicable fees charged by your payment provider.
- Refunds are handled according to the policies of your app store or payment processor and applicable law.
5. Free tier & advertising
Free users receive a limited number of AI scans per day. Watching optional rewarded advertisements may grant additional scans subject to daily caps and cooldowns. We do not guarantee ad availability.
6. Acceptable use
You agree not to:
- Use the App for unlawful purposes or to violate others’ rights
- Reverse engineer, scrape, or overload our systems or AI APIs
- Upload harmful, abusive, or non-food content to circumvent limits
- Share account credentials or resell access to the Service
- Misrepresent AI output as professional medical or dietary advice
7. Nutrition & health disclaimer
ScanBite provides estimates only. AI results may be inaccurate, incomplete, or unsuitable for your health needs. The App is not a medical device and does not diagnose, treat, or prevent disease. 8. Intellectual property
The App, branding, and content we provide are owned by Alright Tech, ScanBite, or licensors. You retain rights to photos and data you submit. You grant us a limited license to process your content solely to operate and improve the Service (including optional anonymized correction learning when enabled).
9. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALRIGHT TECH, SCANBITE, AND THEIR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR HEALTH OUTCOMES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR USD $50, WHICHEVER IS GREATER.
11. Termination
You may stop using the App at any time or delete your account. We may suspend or terminate access if you violate these Terms or for operational reasons. Sections that by nature should survive (disclaimers, liability limits, dispute terms) will survive termination.
12. Governing law
These Terms are governed by the laws of your country of residence or the jurisdiction where Alright Tech is established, without regard to conflict-of-law rules, except where mandatory consumer protections apply in your region.
13. Changes
We may update these Terms. Material changes will be indicated by updating the date above. Continued use constitutes acceptance.
